Terms of Service

1. Introduction

Welcome to INSIDR. These Terms of Service ("Terms") govern your access to and use of the INSIDR website, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Your Account

To access certain features of the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Providing accurate and complete registration information

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

4. The Vault Marketplace

The Vault is a marketplace feature where users can submit and reveal hidden venue recommendations. By participating in The Vault, you agree to the following:

4.1 Submissions

  • You may submit venue recommendations ("Vault Submissions") that represent genuine, personal knowledge of real establishments
  • All submissions must be accurate, truthful, and not misleading
  • You must have personally visited and can vouch for the quality of any venue you submit
  • Submissions that violate our content guidelines may be removed without notice

4.2 Reveals

  • Users can reveal Vault content for free, with a daily limit of one reveal per day
  • Daily reveal limits reset at midnight UTC
  • We reserve the right to modify the reveal system at any time

4.3 Reputation and Leaderboard

  • Contributors earn reputation points based on their submissions and engagement
  • The leaderboard ranks users by their contribution score
  • User tiers (Local, Insider, Legend) are determined by activity and quality

4.4 Ratings and Reviews

  • Users who reveal Vault content may rate their experience
  • Ratings must be honest and reflect genuine experiences
  • We use ratings to maintain quality and may remove poorly-rated submissions

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Fraud: Creating fake accounts, self-revealing your own submissions, coordinating reveals with others, or any form of payment fraud
  • Rating Manipulation: Exchanging ratings, using multiple accounts to rate content, or incentivizing ratings
  • False Submissions: Submitting venues that don't exist, that you haven't visited, or with intentionally misleading information
  • Spam: Submitting duplicate content, bulk low-quality submissions, or content designed to game the system
  • Harassment: Harassing, threatening, or abusing other users
  • Scraping: Using automated tools to access, scrape, or download content from the Service
  • Circumvention: Attempting to bypass security measures or access unauthorized areas of the Service

6. Account Suspension and Bans

We reserve the right to suspend or ban accounts that violate these Terms. Our enforcement system includes:

  • Warnings: For minor or first-time violations
  • Temporary Bans: Progressive bans (7 days, 30 days, 365 days) for repeated violations
  • Permanent Bans: For severe violations or continued abuse

Vault-related bans restrict your ability to submit, reveal, or earn from The Vault but do not affect access to curated content. We may also forfeit any pending earnings from accounts engaged in fraud.

7. User Content

By submitting content to the Service, including Vault Submissions, you grant INSIDR a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute your content in connection with the Service.

You represent that you own or have the necessary rights to all content you submit and that your content does not infringe on any third-party rights.

8. Third-Party Services

The Service integrates with third-party services including:

  • Mapbox: For map displays and location services
  • Supabase: For authentication and data storage
  • Google Maps: For venue information and directions

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • Venue information, including Vault Submissions, is accurate, complete, or current
  • Any venue will meet your expectations or that your experience will match others' descriptions
  • Venues listed remain open, maintain quality, or continue to exist

You use The Vault at your own risk. We do not guarantee the quality of any user-submitted venue recommendations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSIDR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO INSIDR IN THE PAST 12 MONTHS, OR (B) $100 USD.

11. Indemnification

You agree to indemnify and hold harmless INSIDR and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Germany. If you are a consumer residing in the European Union, you may also be entitled to bring proceedings in the courts of your country of residence.
